Acceptance of Terms
By accessing, downloading, or using Mercury Mobility platform, you agree to these Terms of Service in their entirety. If you do not accept these Terms, do not use the Service.
We reserve the right to modify these Terms. Continued use indicates your acceptance of updated Terms.
User Eligibility
To use Mercury Mobility, you must:
- Be at least 18 years of age
- Possess a valid, current driving license
- Not be prohibited by law from operating vehicles
- Complete full KYC verification
- Have legal capacity to enter contracts
Account Registration
KYC Verification
Complete KYC verification including government ID, address verification, phone/email verification, and driving license validation.
Account Security
- You are responsible for your login credentials
- Do not share your password
- You are liable for all account activities
- Notify us immediately of unauthorized access
Vehicle Usage Terms
Your Responsibilities
- Operate vehicle in compliance with traffic laws
- Not operate while intoxicated or impaired
- Not use vehicle for commercial purposes without authorization
- Not exceed service area boundaries
- Return vehicle in same condition (normal wear excepted)
- Follow minimum battery/fuel requirements
Prohibited Activities
- Racing, stunts, or illegal activities
- Smoking or consuming alcohol inside vehicle
- Tampering with vehicle equipment
- Taking vehicle outside service area
- Transporting hazardous materials
Mileage & Time Charges
Charges are based on rental duration and/or distance traveled. All rates are displayed in the app before confirmation.
Parking & Traffic Violations
You are responsible for all parking charges, tolls, and traffic violations. Fines will be deducted from your account or invoiced separately.
Payment & Billing
Payment Methods
- Credit/debit cards (Visa, Mastercard, RuPay)
- UPI (Google Pay, PhonePe, Paytm, etc.)
- Digital wallets
- Bank transfers
- In-app wallet
Pricing & Charges
All prices include GST. Charges based on rental completion. Damage charges, fines, and late fees billed separately.
Refund Policy
- Cancel 30+ min before booking: 100% refund
- Cancel 0–30 min before booking: 50% refund
- Cancel after booking starts: No refund
- No refunds for damage or late fees
- Processed within 5–7 business days
Late Fees
- ₹100 per 15 minutes for late returns
- After 2 hours: vehicle may be remotely disabled
- After 4 hours: considered abandoned
Liability & Damages
Your Liability for Damage
You are liable for all damage during your rental including:
- Exterior damage (scratches, dents)
- Interior damage (torn seats, stains)
- Window/mirror damage
- Tire damage or punctures
- Collision or accident damage
Damage Assessment
- Assessed within 24 hours of return
- Photographic evidence provided
- Dispute window: 48 hours
- Independent inspection available (₹500)
Damage Charges (Typical)
- Minor scratches: ₹500–2,000
- Dents (small): ₹2,000–5,000
- Major damage: ₹15,000–50,000+
- Mechanical damage: Actual repair cost
Accident Procedures
- Report immediately via app
- Obtain police report number if applicable
- Provide photographs and third-party details
- Cooperate with insurance investigation
Company's Limitation of Liability
Company's total liability shall not exceed rental charges paid for that transaction. Company is not liable for special, indirect, or consequential damages.
User Conduct
Prohibited Conduct
- Bypass security features
- Attempt to hack or reverse-engineer Platform
- Engage in fraud or misrepresentation
- Share account credentials
- Harass or abuse staff
- Violate applicable laws
Suspension & Termination
We may suspend or terminate your account immediately if you violate these Terms, engage in illegal activity, repeatedly damage vehicles, or pose safety risks.
Insurance & Liability
Our Coverage
- Third-party liability insurance (mandatory)
- Own damage protection (subject to deductible)
- Personal accident coverage
Your Obligations
- You are responsible for personal accident insurance
- Your auto insurance may not cover rental vehicles
- Optional damage waiver available at booking
- Deductible (₹5,000–10,000) is your responsibility
Termination of Service
Our Right to Terminate
We may terminate your access immediately for violation of these Terms, illegal activity, repeated vehicle damage, non-payment, or safety concerns.
Your Right to Terminate
- Terminate account anytime via app settings
- You remain liable for outstanding charges
- Pending disputes must be resolved first
Dispute Resolution
Informal Resolution
Contact support@mercurymobility.com with dispute details. We aim to respond within 15 business days.
Escalation
Unresolved disputes escalate to our Customer Dispute Resolution Officer for review within 30 days.
Arbitration
For disputes exceeding ₹1,00,000, both parties agree to binding arbitration under the Arbitration and Conciliation Act, 1996.
Court Jurisdiction
For smaller disputes or non-arbitrable matters, exclusive jurisdiction is with courts in India, preferably Delhi or user's location.
Disclaimers
As-Is Disclaimer
The Platform and Service are provided "AS-IS" without warranties. We disclaim all warranties, express or implied, including merchantability or fitness for purpose.
Service Availability
We do not guarantee 24/7 availability or uninterrupted service. Maintenance or technical issues may cause temporary unavailability.
Safety Disclaimer
Vehicle operation carries inherent risks. Users assume all risks associated with vehicle rental and operation.
Governing Law
Jurisdiction
These Terms are governed by Indian law. Specific compliance with Motor Vehicles Act 1988, Information Technology Act 2000, and Consumer Protection Act 2019.
Entire Agreement
These Terms, along with the Privacy Policy, constitute the entire agreement between you and the Company.
